If you answer all the questions your lawyer asks you with thought and consideration, you’re unlikely to miss anything.

If you support someone financially during your life, who you do not plan to benefit after you’ve died, there may be consequences. Your family who are benefiting, may have to deal with a claim against your estate, which might be prevented by careful planning, an appropriate Will and a private Letter of Wishes, explaining the circumstances and your intentions and thought process.

If you’re in the midst of your divorce, and want to get a Will in place which does not provide for your former spouse, ensure that you’ve covered various details with your professional adviser.

Your children may be your main priority now. You may be working towards a “clean break” divorce involving finances being finalised. You may wish to spell out for the avoidance of any doubt, that money passing to your former spouse during your lifetime, is for the benefit of the children, and not the spouse.

If you have assets overseas, you should have a Will there.  The existence of a Will in another jurisdiction, should always be disclosed.  You don’t want to mistakenly revoke it.
